The „specific defined benefit": what it means and what belongs there

Every sentence about the taxation of group health insurance features this convoluted term. It is worth understanding properly once – the entire tax advantage rests on this category.

The three worlds of benefit taxation

In the Hungarian PIT system, an employer benefit – apart from the narrow category of fringe benefits (SZÉP card) – can be taxed three ways. As salary: delivering the same net value costs the company roughly 70% more, because salary is also subject to personal income tax, social security contribution and social contribution tax – part of which is borne by the employee. (This is the same base as the 33.04% calculated on the value of the benefit.) Tax-free: a narrow, itemised list. And in between: as a specific defined benefit – payer-side taxation, 33.04% total burden, borne solely by the payer.

What makes it „specific defined"?

Group insurance premiums are typically taxed as a specific defined benefit, provided the contract meets the conditions of the PIT Act – meaning it is a genuine group contract with an undivided premium, where the part of the premium attributable to one insured person cannot be determined even by apportionment. If the premium can be individualised, the benefit is taxed as salary; the specific classification must be assessed together with the contract. In other words, this is not loophole-hunting: the category follows from how the product genuinely works.

How is it paid?

The payer pays 15% PIT and 13% social contribution tax on 1.18 times the benefit value – 33.04% together. The benefit does not appear as a burden in the employee’s payroll at all: no tax, no contribution is withheld. Administration is simple on the company side too, attached to the monthly premium.

What does NOT fit?

The category is not elastic. If the arrangement is in substance a collection of individual policies (collective umbrella), or contains a savings element with a clear individual premium share, the favourable category is lost and taxation by legal relationship – salary – takes its place.
